1. Overview
At Smarty Homework LLC (“Smarty,” “we,” “our,” or “us”), we take privacy seriously—especially when designing products for children and families.
This Privacy Policy explains how information is processed when you use our website, mobile application, and related products or services (collectively, the “Service”).
This Policy is intended to be clear and transparent. Where required by law, parental consent is obtained before collecting personal information from children.
The Service is intended for users located in the United States.
2. Information We Collect
Smarty is intentionally designed to minimize data collection. The information processed depends on how the Service is used.
a. Accounts (When Created)
Some features may require creating an account. When an account is created, we may collect:
- Name
- Email address
- Age range or grade level (as provided or approved by a parent)
For users under 13, a parent or guardian’s email address is required. We do not knowingly activate child accounts that collect personal information without parental involvement.
Accounts may also be created using third-party authentication providers such as Google or Apple. In those cases, we receive limited information (such as name and email address) consistent with the provider’s authorization flow.
b. AI Interactions and Learning Use
When users interact with Smarty’s AI-powered features, text inputs are processed in real time to generate responses.
Smarty does not create chat histories for non-logged-in users.
To operate and secure the Service, message content may be temporarily processed and, in limited cases, retained by our service providers solely for operational purposes such as:
- System reliability
- Abuse prevention
- Security monitoring
This data is typically retained only for a short period (for example, up to 30 days, depending on the service provider).
Messages are not used for advertising, profiling, or AI model training. Smarty does not learn from individual conversations or adapt its behavior based on past interactions.
c. Speech, Audio, and Uploads
Smarty may introduce optional features such as speech-to-text or document uploads in the future. If enabled, audio or uploaded content would be processed only to provide the requested functionality.
Smarty does not use audio data to build voice models and does not permit uploads for non-logged-in users.
d. Technical and Operational Data
We may automatically process limited technical information, including:
- Device and browser type
- IP address (used temporarily for security, fraud prevention, and service operations)
- Error logs and performance metrics
This information is used to maintain functionality, prevent misuse, and improve reliability.
e. Payment Information
Payments are processed securely by third-party payment providers (such as Stripe, Apple, or Google). Smarty does not store or have access to full credit card or banking details.
f. Communications
If you contact us or opt in to communications, we may process your contact information and preferences to respond or provide requested updates. You may opt out of non-essential communications at any time.
3. How We Use Information
We process information only as necessary to:
- Provide and operate the Service
- Generate AI-powered educational responses
- Maintain safety, reliability, and security
- Respond to support requests
- Comply with legal obligations
We process information to fulfill our contractual obligations to you and to operate the Service in accordance with applicable laws.
Smarty does not sell, rent, or trade personal information.
Smarty does not use personal information for targeted advertising.
For convenience, Smarty may store non-personal, device-only information (such as a masked email or child nickname) locally on your device to help you sign in faster. This information is not transmitted to our servers and is not used for tracking or profiling.
4. AI-Powered Features
Smarty uses trusted third-party AI service providers to generate responses in real time.
Inputs may be temporarily processed by these providers for operational purposes such as reliability and abuse prevention. Smarty does not retain AI conversations as chat histories for non-logged-in users.
Smarty does not use AI interactions to build user profiles, serve advertisements, or train AI models.
Users should avoid entering personal or sensitive information (such as full names, addresses, or school details) when using AI features.
5. Cookies and Tracking
Smarty uses limited cookies and similar technologies necessary for basic functionality and security.
We do not use behavioral advertising cookies for child users and do not knowingly engage in cross-context behavioral advertising for children.
Where analytics are used, they are configured to minimize data collection and are not used to identify individual children.
Smarty does not respond to browser “Do Not Track” signals.
6. Service Providers and Data Sharing
Smarty shares information only with trusted service providers that help operate the Service, including:
- Application infrastructure providers (such as Lovable)
- AI response providers (such as Google Gemini)
- Payment processors
Service providers process information on Smarty’s behalf and are contractually restricted from using the data for advertising or AI model training.
Smarty does not sell personal information.
7. Children’s Privacy (COPPA)
Smarty is designed to minimize the collection of personal information from children.
Children may use Smarty without creating an account. In these cases:
- No chat histories are created
- No user profiles are generated
- Messages are processed only to generate immediate responses
If an account is created for a child under 13, parental involvement is required. Parents may review, update, or request deletion of their child’s information by contacting privacy@smartyhomework.com.
If we learn that personal information was collected from a child under 13 without appropriate parental involvement, we will delete that information promptly.
8. Data Retention and Security
Smarty does not retain chat histories for non-logged-in users.
Service providers may temporarily retain message data for limited periods (typically up to 30 days) to support system operations, security, and abuse prevention.
We will respond to verified data deletion requests within a reasonable timeframe in accordance with applicable laws.
We use reasonable administrative, technical, and organizational safeguards to protect information. However, no system is completely secure.
9. Your Privacy Rights
Depending on your location, you may have rights to:
- Access personal information
- Request deletion of personal information
- Correct inaccurate information
- Withdraw consent where applicable
Requests may be submitted to privacy@smartyhomework.com.
10. California Privacy Rights (CCPA/CPRA)
California residents may have the right to:
- Request access to personal information
- Request correction or deletion
- Opt out of the sale or sharing of personal information
Smarty does not sell or share personal information.
11. Third-Party Links
The Service may contain links to third-party websites. Smarty is not responsible for the privacy practices of those sites.
12. Updates to This Policy
We may update this Privacy Policy periodically.
When material changes are made, we will update the effective date and provide notice where required.
